By accessing and using the FUPAY platform, mobile application, or any related services (collectively referred to as "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms").

2. Services Description

FUPAY provides digital payment solutions and financial services including:

• Payment Processing: UPI payments, QR code payments, card payments, netbanking
• Money Transfer: IMPS, NEFT, RTGS, and UPI transfers
• Bill Payments: Utility bills, mobile recharge, DTH recharge
• Business Solutions: Payment gateway integration, merchant services
• Financial Services: Digital wallet, prepaid cards, lending services

2.1 Service Availability

We strive to provide uninterrupted service, but we do not guarantee 24/7 availability. Services may be temporarily unavailable due to maintenance, technical issues, or regulatory requirements.

3. Eligibility and Registration

3.1 Eligibility Criteria

• You must be at least 18 years old
• You must be a resident of India
• You must have a valid mobile number and email address
• You must comply with KYC requirements as applicable

3.2 Registration Process

To use our Services, you must:

• Complete the registration form with accurate information
• Verify your mobile number and email address
• Complete KYC verification as required
• Accept these Terms and Privacy Policy

4. User Obligations

As a user of FUPAY Services, you agree to:

• Provide Accurate Information: Submit only true, accurate, and complete information
• Comply with Laws: Use Services in compliance with applicable laws and regulations
• Maintain Security: Keep your account credentials secure and confidential
• Report Issues: Promptly report any errors, unauthorized transactions, or security concerns
• Pay Fees: Pay all applicable fees and charges for Services used
• Update Information: Keep your contact and personal information updated

5. Prohibited Activities

You agree not to use our Services for any illegal or unauthorized purpose, including:

• Illegal Activities: Money laundering, fraud, terrorist financing
• Unauthorized Access: Attempting to gain unauthorized access to our systems
• Interference: Interfering with or disrupting our Services
• False Information: Providing false or misleading information
• Resale: Reselling or redistributing our Services without permission
• Violation of Rights: Infringing on intellectual property or other rights

6. Fees and Charges

6.1 Service Fees

We may charge fees for various Services. All fees are clearly disclosed before you complete a transaction.

6.2 Fee Structure

• Transaction Fees: Applicable on money transfers and payments
• Processing Fees: Charges for payment processing services
• Monthly Fees: Subscription fees for premium services
• Penalty Charges: Late payment or violation penalties

6.3 Fee Changes

We reserve the right to modify our fee structure with 30 days' notice. Continued use of Services after fee changes constitutes acceptance of new fees.

7. Limitation of Liability

7.1 General Limitation

FUPAY's total liability to you for any claims arising from the use of our Services shall not exceed the amount of fees paid by you in the 12 months preceding the claim.

7.2 Exclusions

We shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages caused by third-party services or systems
• Force majeure events beyond our control

8. Termination

8.1 Termination by User

You may terminate your account at any time by contacting our customer support. Upon termination:

• Your access to Services will be immediately suspended
• Outstanding transactions will be processed according to our policies
• Your data will be retained as per our Privacy Policy

8.2 Termination by FUPAY

We may terminate or suspend your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Required by law or regulatory authorities
• For security or risk management reasons

9. Governing Law and Dispute Resolution

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Alwar, Rajasthan.

9.2 Dispute Resolution

In case of any dispute:

• First, attempt to resolve through our grievance redressal mechanism
• If unresolved, the matter shall be referred to arbitration
• Arbitration shall be conducted in accordance with Indian law
